Common Arguments — and What the Facts Show
Automated license plate readers are often defended with a handful of familiar arguments. Some contain an element of truth. But they frequently leave out the larger question: whether government should create searchable records of the movements of people who are suspected of no crime.
This page takes those arguments seriously, answers them with sourced facts, and asks the questions we believe the public should be asking.
“If you have nothing to hide, you shouldn't care if you're being watched.”
That asks the wrong question. The issue is not whether someone is hiding wrongdoing. The issue is whether government should create a searchable record of where ordinary people travel when there is no reason to suspect them of a crime.
California law defines an ALPR system as a “searchable computerized database” created from camera images and algorithms that convert license plates into computer-readable data.
The question to ask: Why should government maintain a searchable movement record about someone it has no reason to investigate?

“License plates are public. Anyone can see them.”
Yes. A person standing on a public street can see a license plate. That is not the same capability as automatically recording plate data, time and location and making those observations searchable later.
Flock says its ALPR product collects license plate images, vehicle characteristics, date and time stamps, and camera-location identifiers. Flock also describes searching by date and time, vehicle characteristics, and full or partial plate information.
The question to ask: Is seeing a car drive past the same thing as being able to search a database later to determine when and where that car was observed?

“But Flock helps catch criminals.”
It can. Law-enforcement agencies have reported arrests and vehicle recoveries associated with ALPR alerts. That is a legitimate benefit to consider.
But demonstrating that a surveillance system sometimes produces useful investigative leads does not answer whether recording everyone else is necessary or proportionate.
The question to ask: How many vehicle observations involving people suspected of no crime were collected to produce those investigative successes?
The public deserves the denominator.

“Police have always been able to watch cars on public streets.”
Yes. What changes is scale and searchability. Traditional observation requires someone to be present or to review particular evidence. An ALPR system converts observations into computer-readable records that can be searched later.
The question to ask: Should the ability to observe something in public automatically justify building a database that makes those observations searchable afterward?

“The data is only kept for 30 days — or now only seven days.”
A shorter retention period reduces how long historical observations remain available. It does not change the fact that observations are collected and searchable during that period.
Flock historically described 30 days as its standard retention period. In August 2026, Flock announced that it was changing its recommended default to seven days and introducing a mechanism for preserving selected data for active investigations.
The question to ask: If a person is suspected of no crime, why should government need seven days of searchable travel observations about that person?

“Policies and audit logs prevent abuse.”
Policies, access controls and audit logs are useful safeguards. Flock says approved users have role-based access and that searches are recorded and reviewable.
Those safeguards govern the use of a capability; they do not eliminate the capability itself. Oversight therefore still matters: who can search, what constitutes an acceptable reason, who reviews the logs, how sharing is configured, and what happens when a policy is violated.
The question to ask: Who independently checks the audit trail, how often, and what consequences follow an improper search?

“It's basically just another security camera.”
ALPR is designed around structured search. California DOJ describes an ALPR system as a searchable computerized database. Flock describes searches using plate information, time windows and vehicle characteristics.
The question to ask: Would an ordinary security camera let an investigator enter vehicle characteristics or a partial plate and search historical observations across a network?

“It makes police work more efficient.”
That may be true. Searchable databases can make investigations faster. But efficiency is a benefit to weigh, not a complete answer to questions about privacy, necessity, access and oversight.
The question to ask: What limits should apply to a government surveillance capability even when that capability makes investigations easier?

“We don't use it for immigration enforcement or other prohibited purposes.”
Restrictions on use matter, and California imposes legal requirements on the collection, storage, sharing and use of ALPR information.
But restrictions must still be implemented, audited and enforced. A written restriction is meaningful only when technical controls, access controls, audit logs and effective oversight ensure that the restriction is actually followed.
The question to ask: What technical controls prevent prohibited access, and how does the public verify that those controls continue to work?
“Look at all the crimes we've solved with it.”
Those results belong in the discussion. So do the system's scale, cost, number of searches, number of vehicle observations, sharing arrangements, retention period and audit results.
Reported arrests, vehicle recoveries and other investigative successes tell the public something about outcomes. Those figures should be reported. But outcome totals alone do not tell us how many vehicle observations, searches or records were collected to produce those results.
The question to ask: What is the denominator?
Public surveillance programs should be evaluated with both their successes and their scale visible.
